Wat is inbreuk op intellectueel eigendom??

U gebruikt een naam voor uw onderneming of een onderscheidingsteken of specifiek ontwerp voor uw producten. Na verloop van tijd ziet u dat anderen hetzelfde ontwerp of onderscheidingsteken gebruiken voor hun producten gebruiken en u wilt zich daartegen verzetten. Of omgekeerd, u wordt aangesproken dat u inbreuk zou maken op intellectuele eigendomsrechten van anderen.

Met andere woorden: Lagunisol maakt gebruik van haar eigen LOGO.

Indien anderen daar ook gebruik van maken, dan betekent dat nog niet dat zij EIGENAAR van dit LOGO zijn.

 

Statuten Vereniging van Eigenaren in het Lagunisol Resort.

 

Definities

Artikel 1

In deze statuten en de huishoudelijke reglementen wordt verstaan onder:

a.  "vereniging": de bij deze akte opgerichte vereniging;

b.  "algemene vergadering": de algemene vergadering van de leden;

c.  "het bestuur": het bestuur van de vereniging;

d.  "projectfaciliteiten"; alle zaken die bestemd zijn om door of ten behoeve van alle eigenaren van kavels binnen het Lagunisol project te worden gebruikt, zoals tuinen, parkeerplaatsen, paden, wegen, zwembad, tennisbaan, beveiligings-systemen, centrale antenne systemen en dergelijke;

e.  "lid": ieder die in een rechtsverhouding van lidmaatschap tot de vereniging staat;

f.  "gebruiker": degene, die krachtens een overeenkomst met een lid derhalve anders dan krachtens een lidmaatschap het recht heeft op het medegebruik en nut van projectfaciliteiten en het genot van de door de vereniging te verlenen diensten.

 

Naam en zetel

Artikel 2

De vereniging draagt de naam: "Vereniging van Eigenaren in het Lagunisol Resort" en is gevestigd te Curaçao.
